Abstract

This review provides a critical analysis of Moh. Mufid’s Fikih Kelautan: Mengelola Potensi Laut Perspektif Maqāshid al-Syarī’ah (2025), a pioneering work that seeks to establish maritime fiqh as a domain of contemporary Islamic legal scholarship. The review contextualizes the book within pressing issues such as marine environmental degradation, climate change, and the vulnerability of coastal communities, emphasizing its endeavor to link Islamic jurisprudence with ecological sustainability. It examines the book’s conceptual framework, focusing on the integration of fiqh, maqasid sharia, ecotheology, and the concept of active farḍ kifāyah. The review contends that the book’s primary contribution lies in broadening the scope of contemporary fiqh to encompass marine governance and environmental stewardship. Concurrently, it identifies methodological and conceptual challenges related to ḥifẓ al-bī'ah, the operationalization of maṣlaḥah, empirical engagement, institutional accountability, and interdisciplinary collaboration. In sum, the book lays the groundwork for a research agenda in Islamic environmental law.
